BABY ON THE MOVE — HIRE AGREEMENT: KEY TERMS (SUMMARY)

These summary terms sit alongside our full Terms & Conditions (see website) and our Privacy Policy at babyonthemove.co.nz/Privacy-Policy/. All definitions are set out in those documents.

1) Who can hire
The Hirer must be 18 years or older and provide valid photo ID and contact details. We may decline a hire where ID cannot be verified, or safe use of the equipment cannot be assured.

2) Deposit, bond & payment
A non-refundable 20% deposit (down payment) of the order total is required at the time of booking. The remaining balance and bond are due on collection.
The bond may be applied to lawful charges (for example damage, missing parts, late fees, or cleaning/biohazards). Any remaining balance will be refunded within 5–10 business days of the item being returned and inspected.
The bond amount is $50 per hire agreement. Unclaimed bonds after 6 months from the return date may be forfeited.

3) Hire period & peak season
Rent is payable from the Hire Pickup Date until the equipment is returned in the required condition.
A 20% peak-season surcharge applies from 1 December to 8 February (inclusive). If either the pickup date or return date falls within this period, the surcharge applies. Standard pricing applies outside these dates.

4) Cancellations, early returns & extensions
A 20% hire deposit (down payment) is required at the time of booking and is non-refundable if the hire is cancelled or changed. No refund is provided for unused hire periods unless required by law.
We understand that circumstances can change during pregnancy. If a hire needs to be cancelled due to medical reasons, please contact us and we will work with you to arrange an appropriate refund.
Hire extensions must be requested before the Return Date, are subject to availability, and require pre-payment.

5) Using & caring for the equipment
The equipment must be used in accordance with the manufacturer’s instructions and New Zealand law at all times.
Do not modify equipment or use after-market accessories not approved by the manufacturer (for example extra mattresses, strap covers, liners, wedges, or unapproved protectors).
Items must be kept clean, dry, smoke-free, and away from damaging heat or chemicals.
Equipment must not be sub-hired, lent to another party, or taken overseas without written consent.
If we discover that the equipment has been modified or used in a way that breaches this clause, we may refer the equipment to the manufacturer for inspection. The manufacturer may determine that the warranty has been voided, and the Hirer may be responsible for replacement costs.

6) Cleaning, biohazards & missing parts
Items must be returned clean, dry, and odour-free.
Cleaning or biohazard fees may apply for heavy soiling (for example vomit, urine, faeces, or mould) or where non-cleanable parts must be replaced.
All parts and manuals supplied with the hire item must be returned, including inserts, bolts, covers, adapters, chargers, and carry bags.
The $50 bond may be retained to cover cleaning, repair, or replacement costs. If these costs exceed the bond amount, the additional balance will be charged to the customer responsible for the hire. Fees vary depending on the item and retail replacement costs.

7) Loss, damage & late returns
The Hirer is liable for theft, loss, or damage while the item is on hire and must notify us immediately if any issue occurs.
Late returns are charged at the equivalent daily hire rate of the product (per day or part thereof) based on the 1–7 day hire rate, including any peak surcharge, until the item is returned.
Any replacement of products or parts will be charged at the full retail replacement cost.
If an identical product or part is no longer available, the replacement cost will be based on the current retail price of an equivalent product or part of similar type and quality.
After a reasonable period, non-return may be treated as loss, and full retail replacement costs and recovery fees may apply.

8) Child restraints — crash policy
If a hired child restraint is involved in any vehicle crash, stop using it immediately and contact us.
The restraint may need to be retired or inspected in accordance with manufacturer guidance. A replacement hire may be offered.
You may be responsible for the retail replacement value, which may be claimable through your insurance.

9) Installation & compatibility
Installations are performed in accordance with manufacturer instructions and vehicle compatibility requirements.
We may decline an installation or use where the vehicle, installation environment, or compatibility requirements make safe installation impossible.

10) Safety recalls & substitutions
We may contact you regarding product recalls or safety notices.
Where necessary, we may substitute the hired product with an equivalent safe product during the hire period at our cost.

11) Electrical items & chargers
Only the supplied or manufacturer-approved chargers or adaptors may be used with electrical hire items.
Damage caused by incorrect power use may be charged at the full retail replacement cost of the item or part at the time of replacement.

12) Inspection & condition report
We may complete a condition checklist and photographs at hand-over and assess the condition again when the equipment is returned.

13) Termination
We may terminate a hire immediately if the equipment is at risk (for example imminent damage), or where there is a material breach of the Terms and Conditions or insolvency of the Hirer.
Upon termination, the equipment must be returned immediately at the Hirer’s cost.

15) Your statutory rights
Nothing in this Hire Agreement limits your non-excludable rights under the CGA where you are a consumer.
